EL RANCHO SUPERMERCADO ENCUENTRA EL BALÓN DE ORO OFICIAL RULES, PARTICIPATION AGREEMENT AND PRIVACY NOTICE («OFFICIAL RULES»)

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO PARTICIPATE OR RECEIVE A REWARD IN THE EL RANCHO SUPERMERCADO ENCUENTRA EL BALÓN DE ORO (“PROMOTION”). VOID WHERE PROHIBITED BY LAW. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF RECEIVING A REWARD. PARTICIPATION IN THE PROMOTION CONSTITUTES YOUR AGREEMENT TO BE BOUND BY THESE OFFICIAL RULES. THESE OFFICIAL RULES ARE SUBJECT TO BINDING ARBITRATION AND A WAIVER OF CLASS ACTION RIGHTS AS DETAILED IN SECTION 10, BELOW.
PROMOTER/PROMOTER: Mexico Foods, LLC, 16775 Addison Rd., #200, Addison, TX 75001 “Promoter”).
The El Rancho Supermercado Encuentra El Balón de Oro (“Promotion”) begins at 8:00 AM CST for each participating El Rancho Supermercado store location (“Location”) on June 7, 2026, and ends at 7:00 PM CST on June 14, 2026 (the “Promotion Period”). The Promotion will solely take place during store hours at each of the 29 participating Locations. The Promotion Period will be divided into two (2) individual daily periods; one (1) for June 7, 2026, and one (1) for June 14, 2026 (each, a “Daily Period”). Each Daily Period will consist of two (2) game periods with “Game Period 1” beginning at 8:00 AM CST and ending at 1:00 PM CST, and “Game Period 2” beginning at 2:00 PM CST and ending at 7:00 PM CST at each participating Location, or when all hidden Golden Soccer Balls (as further outlined below) for any Game Period at a participating Location have been found, whichever is sooner.
1.Promotion is open only to residents of Texas or Kansas who reside within a fifty (50) mile radius of an El Rancho Supermercado location (the “Promotion Area”) that are United States citizens or legal residents. Employees of Promoter, and their respective parents, affiliates, subsidiaries, retailers and advertising and promotion agencies, as well as the immediate family (spouse, parents, siblings, children and each of their respective spouses, regardless of where they reside), designated shoppers and household members of each such employee, whether related or not, are not eligible to participate or receive a reward. The Promotion is governed by U.S. law and is subject to all applicable federal, state, and local laws and regulations. 2.TO PARTICIPATE Prior to the beginning of each Game Period 1, and each hour thereafter until the end of Game Period 1, one (1) Golden Soccer Ball will be placed by store associates at each participating Location, for a total of five (5) Golden Soccer Balls by the end of Game Period 1. Prior to the beginning of each Game Period 2, and each hour thereafter until the end of Game Period 2, one (1) Golden Soccer Ball will be placed by store associates at each participating Location, for a total of five (5) Golden Soccer Balls by the end of Game Period 2. The potential reward for finding a Golden Soccer Ball will be a $25 El Rancho Supermercado Gift Card. Promoter may, at its sole discretion, post clues on social media with a hint as to where the Golden Soccer Ball will be hidden (i.e., “The next Golden Soccer Ball is placed next to something green.”). The first eligible individual to identify and arrive at the location of a hidden Golden Soccer Ball will be deemed a potential reward recipient of the corresponding reward and will be instructed to bring the Golden Soccer Ball to a store associate to obtain their reward. Decisions of Promoter are final and binding in all matters relating to the Promotion. Promoter’s determination of the first eligible individual to identify and arrive at each location of a Golden Soccer Ball will be final. Inappropriate or aggressive behavior amongst participants at any hidden Golden Soccer Ball location will not be tolerated and may result in such individuals being disqualified from participation in the Promotion, in Promoter’s sole discretion. If there is a tie, or multiple individuals arrive at a hidden Golden Soccer Ball location at the same time, Promoter reserves the right to break the tie at its sole discretion and provide one individual with the corresponding reward. If any of the five (5) Golden Soccer Balls are not located by the end of Game Period 1 at any participating Location, the Golden Soccer Balls still hidden will remain available to be located and awarded during Game Period 2 at that Location. If any hidden Golden Soccer Balls are not identified and located by the end of anySoccer Ball that were not identified and located by the end of the Daily Period. Any/all transportation and costs associated with traveling to/from a participating Location will not be provided and will be each participant’s sole responsibility.responsibility.
3. REWARDS. Ten (10) $25 El Rancho Supermercado Gift Cards available at each participating Location for each of the two (2) Daily Periods. Limit one (1) reward per person each Daily Period, regardless of participating Location(s) visited. One-time use only. No adjustments to prior purchases. No cash value or rainchecks issued. All reward details are at the sole discretion of the Promoter. Any difference between stated value and actual value will not be awarded. Rewards are subject to certain terms and conditions as specified by issuer. All federal, state and local taxes and all other costs associated with reward acceptance and use not specified herein as being provided are the sole responsibility of the reward recipients. All rewards are awarded “as is” with no warranty or guarantee, either express or implied. No substitution, transfer, or cash equivalent of reward is permitted, except by Promoter, which reserves the right to substitute a reward with one of comparable or greater value, at its sole discretion.
4. FOOTAGE. Individuals arriving at the locations of the hidden Golden Soccer Balls may be photographed, videotaped and otherwise recorded by Promoter (collectively, “Footage”). Footage will be owned by Promoter who has the right to use, edit, adapt, post, stream, copy and exploit such Footage and all elements embodied therein, including any names and likenesses embodied therein, in any and all media now known or hereafter devised throughout the world, for a period of two (2) years from the date the reward is earned, for advertising, promotional, trade and other purposes. By accepting a reward, reward recipients agree that his/her name and likeness and those of any other individuals present at the applicable hidden Golden Soccer Balls location(s) may be included in the Footage, in Promoter’s sole discretion. Reward recipients agree to help Promoter obtain necessary releases (as applicable) if requested by Promoter to do so.
5. GENERAL CONDITIONS. Promoter reserves the right to verify the eligibility of all entrants. By entering thisPromotion, entrants accept and agree to these Official Rules, the Privacy Policy (further outlined below) and the decisions of Promoter, which shall be final in all matters. This Promotion may use social media, including Facebook and Instagram to publish or post submitted entries or Promotion winner(s). This Promotion is not endorsed or certified by Facebook or Instagram. All Facebookand Instagram trademarks are the property of Facebook or Instagram. All questions, comments, or complaints regarding the Promotion should be directed to the Promoter at the address listed below and not to Facebook or Instagram. Entrants waive any right to claim ambiguity in the Promotion or these Official Rules. All entrants agree to follow and adhere to these Official Rules. Promoter reserves the right to modify the Promotion and the right to make changes or additions to these Official Rules. Promoter’s failure to enforce any term of these Official Rules shall not constitute a waiver of any term of these Official Rules.
6. RELEASES AND LIMITATION OF LIABILITY. By participating in this Promotion, entrants waive all right to, and release and hold Promoter, Facebook, Inc. and Instagram, Inc., and each of their respective employees, officers, directors,agents, representatives, owners, managers (collectively, “Released Parties”) harmless from, any claim, liability, loss, damage (including punitive, incidental, and consequential damages), or expense (including attorneys’ fees) arising out of or in connection with participation in the Promotion, submission of a photograph or other submission, or the selection of reward recipients or the acceptance, use, or misuse of any reward. Each reward recipient, by acceptance of a reward, except where legally prohibited, grants permission for Promoter and its designees to use his/her name, address (city and state), photograph, image, voice and/or other likeness and reward information for advertising, trade and promotional purposes without further compensation, in all media now known or hereafter discovered, worldwide for a period of two (2) years from the date the reward was earned, without notice or review or approval. In the event of a dispute between individuals for any reward found, Promoter’s decision as to who will be rewarded the reward will be final. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU.
Promoter will not be responsible for errors which may occur in connection with the administration of the Promotion, the availability or dispersion of hidden Golden Soccer Balls or in any Promotion-related materials. Golden Soccer Balls are void if not obtained through authorized, legitimate channels, or if any Golden Soccer Balls or Promotion material is defective, altered, duplicated, photocopied, forged, counterfeited, mutilated or tampered with in any way. Promoter, Facebook, Inc. and Instagram, Inc. will not be responsible for: a participant’s failure to receive communications regarding the Promotion due to entrant’s spam,junk e- mail, or other security settings or for entrants’ provision of incorrect or otherwise non-functioning contact information; technical, hardware, or software malfunctions, lost or unavailable network connections, or failed, incorrect, inaccurate, incomplete, garbled, or delayed electronic communications whether caused by the sender or by any of the equipment or programming associated with or used in this Promotion; or any typographical, technological, or other error in the publishing of the offer, administration of the Promotion, entrant’s failure to timely or completely submit applicable forms of identification, or any other information as reasonably requested by Promoter, or announcement of the rewards.
7. CANCELLATION; MODIFICATION. Promoter reserves the right to cancel or modify this Promotion, including these Official Rules, in a manner it deems appropriate for any reason, including, but not limited to, if, in Promoter’s sole and absolute discretion, Promoter believes there is an error, any suspected evidence of tampering with any portion of the Promotion, if technical difficulties (including viruses and bugs) compromise the integrity of the Promotion, or any other problem orissue that prevents the Promotion from running as planned; any such modification will be posted here.
8. PARTICIPANT AGREES THAT ALL MATTERS ARISING OUT OF OR RELATING TO THE GIVEAWAY, POST, THESE ADDITIONAL GIVEAWAY RULES AND THE PRIVACY NOTICE, ARE GOVERNED BY, AND CONSTRUED IN ACCORDANCE WITH, THE LAWS OF THE STATE OF TEXAS, UNITED STATES, WITHOUT REFERENCE TO THE CHOICE OF LAW PRINCIPLES THEREOF. PARTICIPANT FURTHER AGREES THAT ANY LEGAL SUIT, ACTION, PROCEEDING, DISPUTE, CONTROVERSY OR CLAIM ARISING OUT OF OR RELATING TO THE GIVEAWAY, POST, THESE ADDITIONAL GIVEAWAY RULES, AND THE PRIVACY NOTICE, SHALL BE BROUGHT EXCLUSIVELY IN THE STATE COURTS OF TEXAS LOCATED IN DALLAS COUNTY, TEXAS OR THE UNITED STATES DISTRICT COURT FOR THE NORTHERN DISTRICT OF TEXAS.

In connection with any privacy-related requests you submit to Promoter in exercising rights to which you are entitled under applicable law, Promoter will undertake steps to verify your identity. Promoter may ask you to provide information that Promoter or has on file about you or, if the request is submitted in writing or electronically, Promoter may contact you via another method (e.g.,phone) to verify your identity. Promoter will only use Personal Information provided in a request to verify the requestor’s identityand authority to make the request and Promoter will maintain a record of any such requests as required by law.
10.MANDATORY ARBITRATION. As a condition of participating in this Promotion, except where prohibited by law, you agree that any dispute, claim, or controversy arising out of or relating to the Promotion, the award of a prize, or the breach, termination, enforcement, interpretation, or validity of the Official Rules, shall be submitted to and determined by JAMS exclusively on an individual, non-class basis pursuant to its Comprehensive Arbitration Rules and Procedures and in accordance with the Expedited Procedures in those Rules. For the avoidance of doubt, you agree that any and all disputes, claims, and causes ofaction arising out of or related to this Promotion or any prize awarded shall be resolved individually and not in the form of any class action or other form of representative action. You agree that, as a condition of participating in this Promotion, you and all entrants waive any right to bring any action arising from or related to the Promotion or the award of a prize as a class or other representative action.
The arbitration shall be held before a single arbitrator, who shall be an attorney at law and an experienced commercial and contract law arbitrator. The Promoter shall bear the cost of the arbitration, including the compensation of the Arbitrator and all administrative expenses. The parties may be represented by their own attorneys in the arbitration proceeding and, except as may otherwise be required by law, shall be responsible for their own attorneys’ fees and costs incurred in presenting their case to the Arbitrator.
The Arbitrator shall have the power to award all legal relief available in a court of law, including any and all damages that may be available for any of the claims asserted, provided, however, that the arbitrator may not award any incidental, indirect, or consequential damages, including damages for lost profits, or any other relief waived under this Agreement. In addition, each of theparties shall retain all defenses that they would have in a judicial proceeding, including defenses based on the expiration of the statute of limitations and that the damages being sought are not authorized or are excessive.
The Arbitrator shall render a written award within thirty (30) days after the matter is submitted for determination, and the award ofthe arbitrator shall be final and binding on the parties. Judgment on the award may be entered in any court having jurisdiction. This provision, however, shall not preclude the parties hereto from seeking provisional remedies in aid of arbitration from a court of appropriate jurisdiction, including preliminary injunctive relief.
You agree and acknowledge that the Promotion evidences a transaction involving interstate commerce and that this Agreement is entered into under the Federal Arbitration Act (“FAA.”) Accordingly, this Agreement shall be interpreted and construed inaccordance with the law and procedures developed under the FAA. The parties shall maintain the confidential nature of the arbitration proceeding and the Award. You agree that by participating in the Promotion, you also enter into this agreement to arbitrate freely and voluntarily and without any form of coercion, duress or undue influence.
